Road accidents

Representation for drivers, passengers and pedestrians injured in road accidents, addressing both the injury and its impact on everyday life.

For personal injury claims under the Israeli Road Accident Victims Compensation Law, entitlement does not depend on who caused the accident. Compensation is generally sought from the relevant compulsory motor insurer. Eligibility is subject to the law and its exceptions, so compensation is not automatic in every case. The circumstances, insurance coverage and injury must be assessed.

A fall on a street, in a shop or in another public place does not automatically entitle someone to compensation. The hazard, responsibility for the premises and the connection between the incident and the injury must be assessed. Photographs, witness details and timely medical records help establish the claim.

Insurance claims

Claims under personal accident, income protection and student accident insurance policies. Reviewing coverage and handling claims.

The process starts with reviewing the policy, coverage, and medical and employment records. Eligibility conditions, exclusions and claim deadlines are assessed before a supported claim is submitted to the insurer. If a claim is rejected, the reasons and available next steps are reviewed.

National Insurance

Claims for general disability, special services, long-term care and child disability benefits. Preparing claims and representing clients before medical committees.

Each benefit has its own eligibility criteria and documentation requirements. The office helps identify the appropriate claim, organise medical and functional evidence, and prepare for and attend medical committees. Once a decision is issued, its implications and any grounds and deadlines for an appeal are assessed.

Ministry of Defense

Assistance with disability recognition applications and representation before medical committees of the Ministry of Defense Rehabilitation Department, including claims arising from injuries sustained during the Swords of Iron war.

The office assists injured service members with recognition and disability assessment proceedings before the Rehabilitation Department, including injuries sustained during the Swords of Iron war. Assistance includes gathering service and medical records, assessing the link between the injury and service, and preparing for and attending medical committees.

What to keep

  • Medical records, emergency department summaries, referrals, test results, medical certificates for absence from work and receipts for injury-related expenses.
  • Details of the drivers, vehicles and compulsory motor insurance, witness contact details and photographs of the scene, if they can be taken safely.
  • Police confirmation of the accident, payslips and records of time off work and assistance needed at home.

Who to contact and what you should know

  • Seek medical attention as needed. Describe the accident and symptoms accurately, and document symptoms that emerge later.
  • Report the accident to the police through the appropriate channel and check what confirmation is needed.
  • Identify the relevant insurer before making a claim. If the accident is work-related, a National Insurance claim may also be relevant.

What to avoid

  • Do not sign a release or final settlement before understanding its consequences.
  • Do not guess details you cannot remember or downplay or exaggerate your symptoms. Give an accurate, consistent account.

What to keep

  • A record of the location, the task you were carrying out, any hazard and witness contact details, together with your report to the employer and their response.
  • The initial medical certificate for your work injury, treatment records, medical certificates confirming your inability to work and receipts.
  • Payslips or, if self-employed, documents showing the work performed and your income.

Who to contact and what you should know

  • If you are an employee, ask your employer for form BL/250, the referral form for medical treatment following a work injury. If you are self-employed, use form BL/283. Do not delay urgent treatment while waiting for a form.
  • A treatment referral is not a claim for work injury benefits. Submit form BL/211 separately with the required documents.
  • A claim for work injury benefits should be submitted within 12 months of the injury. If a disability remains, consider a claim for disability benefits for work injuries.

What to avoid

  • Do not rely only on verbal reports. Keep copies and submission confirmations.
  • Do not assume that returning to work necessarily rules out disability benefits for work injuries.
  • Recognition of a work injury by the National Insurance Institute and the question of employer liability are separate matters.

What to keep

  • Close-up and wider photographs that show the hazard and its surroundings. Keep the original files and a record of when the photographs were taken.
  • The exact address, time, lighting conditions and witness contacts. Check promptly whether relevant CCTV footage exists.
  • Medical records, receipts and the reference number of any report to the municipality.

Who to contact and what you should know

  • Seek treatment as needed and explain how the fall occurred. Report the incident to the party responsible for the premises and retain confirmation.
  • Responsibility may lie with a municipality, business, occupier or another party. It is necessary to establish who controlled the premises and examine the circumstances of the incident.

What to avoid

  • Do not rely on a photograph that fails to identify the location.
  • A fall does not automatically establish a right to compensation. The hazard, legal responsibility, the link to the injury and any contributory negligence must be assessed.
  • Do not delay gathering evidence: hazards may be repaired and recordings deleted.

Living with a disability or difficulties in daily life?

What to keep

  • Up-to-date medical summaries, medical opinions, test results and a list of medications and treatments.
  • Practical examples of difficulties at work and in daily activities, including dressing, washing, eating, moving around the home and supervision needs.
  • Previous decisions, committee reports, income information and submission receipts. For a child disability benefit claim, include assessments and educational reports where relevant.

  • Identify the relevant benefit scheme: general disability, disability resulting from a work injury, special services, long-term care or child disability. Each has its own eligibility conditions.
  • Before the committee hearing, gather your documents and prepare a clear account of your main limitations. Medical, functional or employment factors may be assessed, depending on the type of claim.
  • You can contact National Insurance, use public services that help you prepare for a medical committee, such as Yad Mechavenet, or seek legal representation.

What to avoid

  • Before submitting a new claim, an appeal or an application for reassessment due to a worsening condition, check the appropriate procedure and deadline.
  • A diagnosis alone may be insufficient. Explain how it affects your ability to work and carry out daily activities.
  • Eligibility under one benefit scheme does not automatically establish eligibility under another.
